MAPCABS\nenables the user to engage the Hotel room booking services (\u201cMAPCABS\u201d or\n\u201cMAPCABS App\u201d). Please read these terms of the User Agreement (as defined\nbelow) carefully before downloading and \/or using the services of MAPCABS on\nany of its user interface channels.<\/p>\n\n\n\n<p>The User understands and agrees that\nby using \/ downloading MAPCABS , the User is deemed to have understood and\nexpressly accepted the terms and conditions of the user agreement and privacy\npolicy with the latest amendments and modifications.(\u201cUser Agreement\u201d) of\nMAPCABS App and website.<\/p>\n\n\n\n<p><strong>USER\nAGREEMENT<\/strong><\/p>\n\n\n\n<p>This User Agreement incorporates the\nterms and conditions for MAP CABS Private Limited (\u201cMAPCABS\u201d) to provide\nservices to the person(s) (the \u201cUser&#8221;) intending to avail, subscribe to or\ninquire for any services of MAPCABS by using the app, websites or using any\nother user interface channels of MAPCABS which includes but is not limited to\nthe MAPCABS App&nbsp;<a href=\"http:\/\/(www.mapcabs.in\/hotels)\">(www.mapcabs.in\/hotels)<\/a>&nbsp;, an\napplication developed and maintained by MAPCABS.<\/p>\n\n\n\n<p>MAPCABS, through its MAPCABS App and\nother user interface channels enables the User to check the accessibility and\nconnect with End Service Provider to engage the services of said End Service\nProvider registered with MAPCABS, Hotel room booking services. The service is\ndesigned to offer the User a means of connecting with the End Service Provider\nto engage Hotel room services at the User\u2019s request (\u201cServices\u201d).<\/p>\n\n\n\n<p>End Service Provider shall mean\nVendors \/ Partners registered with MAPCABS.<\/p>\n\n\n\n<p><strong>REGISTRATION\nAND SCOPE OF SERVICE<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>To use the Services, the User is required to register and provide\ncertain personal information including without limitation, name, contact number\nand email address.<\/li><li>The User expressly undertakes to provide to MAPCABS only correct and\nvalid information while requesting for any Services under this User Agreement,\nand not to make any misrepresentation of facts at all. Any default on part of\nthe User would vitiate this User Agreement and shall disentitle the User from\navailing the Services from MAPCABS.<\/li><li>In the event MAPCABS discovers or has reasons to believe at any time\nduring or after receiving a request for Services from the User, that the\nrequest for Services is either unauthorized or the information provided by the\nUser or any of them is not correct or that any fact has been misrepresented by\nhim, MAPCABS in its sole discretion shall have the unrestricted right (without\nprejudice to other rights available under applicable law) to take any steps\nagainst the User(s), including cancellation of the bookings without any prior\nintimation to the User. In such an event, MAPCABS shall not be responsible or\nliable for any loss or damage that may be caused to the User or any of them as\na consequence of such cancellation of Services.<\/li><li>The User unequivocally indemnifies and keeps indemnified MAPCABS of any\nsuch claim or liability and shall not hold MAPCABS responsible for any loss or\ndamage arising out of measures taken by MAPCABS for safeguarding its own\ninterest and that of its genuine Users. This would also include but not be\nlimited to MAPCABS denying\/cancelling any bookings on account of suspected\nfraud transactions.<\/li><li>MAPCABS or the End Service Provider has the right to refuse the Service\nin the following circumstances:<\/li><li>if the User or any other Customer is found to be in an intoxicated state\nor is found misbehaving with other Customer or the End Service Provider, or is\ncausing nuisance;<\/li><li>if the User asks the End Service Provider to break any laws or rules\nincluding without limitation any purpose. The End Service Provider has the\nright to refuse such a request by the User and immediately terminate his\nService<\/li><\/ul>\n\n\n\n<p>In the event the Services are refused\nor terminated due to the above reasons, the End Service Provider and MAPCABS\nare nevertheless entitled to the full fee or charges decided.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>MAPCABS offers are subject to MAPCABS discretion and may be changed or\nrevoked at any time without notice<\/li><li>The User is required to make a request for booking of the Service\nminimum two (2) hours prior to the time of the journey. Bookings made within the\ntwo (2) hour deadline shall not be entertained.<\/li><li>The User shall engage the End Service Provider for a minimum duration of\none (1) hour. The User may request an extension of said duration, subject to\nthe End Service Provider\u2019s availability. The End Service Provider has the\noption of accepting or rejecting the request for extension of duration of\nservice.<\/li><\/ul>\n\n\n\n<p><strong>RESPONSIBILITIES\nOF THE USER<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The Users availing Services from MAPCABS shall be deemed to have read,\nunderstood and expressly accepted the terms and conditions of this User\nAgreement, which shall govern the desired transaction or provision of such\nServices by MAPCABS for all purposes, and shall be binding on the User. All\nrights and liabilities of the User and \/ or MAPCABS with respect to any Services\nto be provided by MAPCABS shall be restricted to the scope of this User\nAgreement.<\/li><li>Further it is the User\u2019s responsibility to review these Terms and\nConditions from time to time. If the User continues to use the Service after\nnotice of change has been intimated or published on MAPCABS\nWebsite\/Application, the User is thereby considered to have provided\nunequivocal consent to the changed terms hereof.<\/li><li>MAPCABS&#8217;s Services are offered to the User conditioned on acceptance\nwithout modification of all the terms, conditions and notices contained in this\nUser Agreement as may be applicable from time to time. For the removal of\ndoubts, it is clarified that availing of the Services by the User constitutes\nan acknowledgement and acceptance by the User of this User Agreement. If the\nUser does not agree with any part of such terms, conditions and notices, the\nUser must not avail MAPCABS\u2019s Services.<\/li><li>While registering, the User will choose a password and is responsible\nfor maintaining the confidentiality of the password and the account. The User\nwill be fully responsible for all activities that occur while using their\npassword or account. It is the duty of the User to notify MAPCABS immediately\nin writing of any unauthorized use of their password or account or any other breach\nof security. MAPCABS will not be liable for any loss that may be incurred by\nthe User as a result of unauthorized use of his password or account, either\nwith or without his knowledge. The User shall not use anyone else&#8217;s password at\nany time.<\/li><li>The User shall be responsible for verifying the identity of the End\nService Provider by examining the End Service Provider\u2019s official Driving\nlicense and government issued identity proof. The User shall also be\nresponsible to check their validity.<\/li><li>The Vendor \/ Partner is solely responsible for any and all liability\nwhich results from or is alleged as a result of the condition of the User Hotel\nroom and legal compliance, including without limitation for personal injuries,\ndeath and property damages which results from the condition of the Vendor \/\nPartner.<\/li><li>Further the Vendor \/ Partner shall be solely responsible for the full\nfunctionality of the Vendor \/ Partner. In the event the Vendor \/ Partner fails\nto serve due to any reason including without limitation electrical, mechanical\nor other, in any way while the Services are being availed of by the User, the\nVendor \/ Partner will be responsible for all assistance and neither MAPCABS nor\nthe End Service Provider shall be responsible in any manner whatsoever<\/li><\/ul>\n\n\n\n<p><strong>RESPONSIBILITIES\nOF MAPCABS<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>MAPCABS has sole and complete discretion to accept or reject each\nrequest for providing the Service. If MAPCABS accepts a request, MAPCABS will\nconfirm the booking and notify the User with information regarding the End\nService Provider including his name and the contact details of the End Service\nProvider to connect using telephone.<\/li><li>MAPCABS shall, subject to the availability of the End Service Provider\nat the User location, at the time of request for the Services, undertake\ncommercially reasonable efforts to connect the User with an End Service\nProvider in order to avail the Services.<\/li><li>The Hotels displayed on the Site may not be available for you in your\nparticular locality. The Hotes displayed in the Site is subject to\navailability.<\/li><li>In the rare possibilities of the reservation not getting confirmed for\nany reason whatsoever, MAPCABS is not under any obligation to make another\nbooking in lieu of or to compensate\/ replace the unconfirmed one. All\nsubsequent further bookings will be treated as new transactions with no\nreference to the earlier unconfirmed reservation.<\/li><\/ul>\n\n\n\n<p><strong>CHARGES\nAND FEES<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The User shall pay the End Service Provider charges as displayed by\nMAPCABS on the MAPCABS` App or other user interface or as agreed to in the\nterms of use as listed on the MAPCABS App or website, parking charges,\nadditional surcharge including without limitation weekend, holidays and peak\nhours charges when applicable, taxes or levy presently payable or hereinafter\nimposed by the law or required to be paid for availing of the Services.<\/li><li>MAPCABS reserves the right to charge an additional transaction fees based\non certain extended or completed transactions using the Services. MAPCABS\nfurther reserves the right to alter any and all fees from time to time, without\nnotice.<\/li><li>In the event there has been any short charging by MAPCABS or End Service\nProvider for Services or transaction fee or any other fee or service because of\nany technical or other reason, MAPCABS reserves the right to\ndeduct\/charge\/claim the balance subsequent to the transaction at its own\ndiscretion.<\/li><li>Any increase in the price charged by either MAPCABS or the End Service\nProvider on account of change in rate of taxes or imposition of new taxes by\nGovernment shall have to be borne by the User.<\/li><\/ul>\n\n\n\n<p><strong>CANCELLATION\nPOLICY<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Greater than 24 hours from the scheduled pick up time we will not charge\nany cancellation fee<\/li><li>4-24 hours, 50% cancellation fee on advance deposit<\/li><li>Within 4hours 100% cancellation fee on advance deposit<\/li><\/ul>\n\n\n\n<p><strong>SAFTEY\nOF DATA AND DOWNLOAD<\/strong><\/p>\n\n\n\n<p>The User understands and agrees that\nany material and\/or data downloaded or otherwise obtained through the use of\nMAPCABS is done entirely at their own discretion and risk and they will be\nsolely responsible for any damage to their computer systems or loss of data\nthat results from the download of such material and\/or data. Further the User\naccepts that it is the User\u2019s responsibility to download, install or ensure the\nuser interface channel used belongs to MAPCABS and not other entity. MAPCABS is\nnot in any way responsible to the wrong download, installation or use of wrong\nuser interface by the User.<\/p>\n\n\n\n<p><strong>NON-SOLICITATION<\/strong><\/p>\n\n\n\n<p>The User agrees and accepts that the\nEnd Service Provider is under contractual agreements with MAPCABS for the\npurpose of Service and therefore are not to be contacted directly by the Users.\nFurther the User hereby agrees not, directly or indirectly solicit, employ or\nin any way procure the services of the End Service Provider either on a\npermanent or temporary basis without the written consent of the MAPCABS.<\/p>\n\n\n\n<p><strong>COMMUNICATION\nBY MAPCABS<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The User agrees that MAPCABS may send booking confirmation, itinerary\ninformation, cancellation, payment confirmation, refund status, schedule change\nor any such other information relevant for the transaction, via SMS or e-mail\nor by voice call on the contact number given by the User at the time of booking.<\/li><li>The User also agrees that MAPCABS may also contact the User by voice\ncall, SMS or email in case the User couldn\u2019t or hasn\u2019t concluded the booking,\nfor any reason what so ever, to know the preference of the User for concluding\nthe booking and also to help the User for the same.<\/li><li>The User hereby unconditionally consents that such communications via\nSMS and e-mail or voice call by MAPCABS<\/li><li>Upon the request and authorization of the User<\/li><li>\u2018Transactional\u2019 and not an \u2018unsolicited commercial communication\u2019 as per\nthe guidelines of Telecom Regulation Authority of India (TRAI) in compliance\nwith the relevant guidelines of TRAI or such other authority in India and\nabroad<\/li><li>The User agrees to indemnify and keep indemnified MAPCABS against all\ntypes of losses and damages incurred by MAPCABS due to any action taken by\nTRAI, Access Providers (as per TRAI regulations) or any other authority due to\nany erroneous compliant raised by the User on MAPCABS with respect to the\nintimations mentioned above or due to a wrong number or email id being provided\nby the User for any reason whatsoever.<\/li><li>Further The User is aware that MAPCABS provides links to services\nthrough MAPCABS App, website or other user interface channels to various End\nService Providers and would like to learn about the service received, to\nenhance his \/ her travel experience. The User hereby specifically authorizes\nMAPCABS to contact the User with offers on various services offered by it\nthrough direct mailers, e-mailers, telephone calls, short messaging services (SMS)\nor any other medium, from time to time. In case that the User chooses not to be\ncontacted, he \/she shall write to MAPCABS for specific exclusion at\nsupport@mapcabs.in . The Users are advised to read and understand the privacy\npolicy of MAPCABS on its MAPCABS App and or website in accordance to which\nMAPCABS contacts, solicits the User or shares the User&#8217;s information.<\/li><\/ul>\n\n\n\n<p><strong>INTELLECTUAL\nPROPERTY RIGHTS<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The ownership of all Intellectual Property rights relating to the\nMAPCABS App, including but not limited to software application, codes, or any\npart or parts thereof, and documentation thereof shall vest solely with\nMAPCABS. The User agrees and undertakes that the User shall not do the\nfollowing:<\/li><li>Reverse engineer, decompile, translate, adapt, vary or modify the\nMAPCABS App including but not limited to the software application in any\nmanner. For the sake of clarification reverse engineer shall include taking\napart the software to see how it works in order to duplicate or enhance the\nobject;<\/li><li>Copy or reproduce the MAPCABS App including but not limited to the\nsoftware application or any part thereof it, to which it might be granted any\naccess or right to use by MAPCABS<\/li><li>In any other way using or misusing the MAPCABS App for purpose\/ purposes\nother than as envisaged under this User Agreement.<\/li><\/ul>\n\n\n\n<p><strong>LIMITATION\nOF LAIBILITY<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The maximum liability on part of MAPCABS arising under any\ncircumstances, in respect of any Services offered on the site, shall be limited\nto the total amount received from the User for availing the Services, less any\ncancellation, refund or others charges, as may be applicable. In no case the\nliability shall include any loss, damage or additional expense whatsoever\nbeyond INR 1000\/.<\/li><li>Neither MAPCABS and\/or its End Service Providers shall be liable for any\ndirect, indirect, punitive, incidental, special, consequential damages or any\ndamages whatsoever including, but not limited to, damages for loss of use, data\nor profits, arising out of or in any way connected with the use or performance\nof the MAPCABS App, website or any other user interface channel.<\/li><li>MAPCABS shall not be responsible for the delay or inability to use the\nMAPCABS App, websites or related services.<\/li><li>MAPCABS shall not be responsible for failure to provide Services, or for\nany information, software, products, services and related graphics obtained\nthrough the MAPCABS App, website, or otherwise arising out of the use of the\nMAPCABS App, website, whether based on contract, tort, negligence, strict\nliability or otherwise.<\/li><li>MAPCABS shall not responsible for any errors, omissions or\nrepresentations on any of its pages or on any links or on any of the linked\napps or website pages.<\/li><\/ul>\n\n\n\n<p><strong>INDEMNIFICATION<\/strong><\/p>\n\n\n\n<p>The User agrees to indemnify, defend\nand hold harmless MAPCABS from and against any and all losses, liabilities,\nclaims, damages, costs and expenses (including legal fees and disbursements in\nconnection therewith and interest chargeable thereon) asserted against or\nincurred by MAPCABS that arise out of, result from, or may be payable by virtue\nof, any breach by the User that arises out of or in relation to the Terms\nstated herein.<\/p>\n\n\n\n<p><strong>TERMINATION<\/strong><\/p>\n\n\n\n<p>MAPCABS reserves the right to suspend\nor terminate the User\u2019s use of MAPCABS App or other user interface if it\nbelieves, in its sole discretion that the User may have breached, infringed or\nviolated any terms and conditions under this User Agreement.<\/p>\n\n\n\n<p>Further, MAPCABS reserves the right\nto suspend or terminate any of its services at will, for any reason whatsoever\nwithout prior notice to the User.<\/p>\n\n\n\n<p><strong>INSURANCE<\/strong><\/p>\n\n\n\n<p>Unless explicitly provided by MAPCABS\nin any specific service or deliverable, obtaining sufficient insurance coverage\nis the sole obligation of the User and MAPCABS doesn&#8217;t accept any claims\narising out of such scenarios.<\/p>\n\n\n\n<p><strong>COVENANTS,\nREPRESENTATIONS AND WARRANTY<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The User represents and confirms that the User is of legal age to enter\ninto a binding contract and is not a person barred from availing the Services\nunder the laws of India or other applicable law.<\/li><li>The User warrants that the User will abide by all additional procedures\nand guidelines, as modified from time to time, in connection with the use of\nthe Services. The User further warrants that they will comply with all\napplicable laws and regulations regarding use of the Services with respect to\nthe jurisdiction concerned for each transaction.<\/li><li>The User represents and warrants that the User has complied with the\nrequirements of the Indian Motor Vehicles Act, 1988 and the respective State\nrules. The User further represents and warrants that the vehicle the User\nwishes the End Service Provider to operate is duly registered as a private\nvehicle and not a commercial vehicle.<\/li><li>Further the User covenants that in the event of a motor vehicle accident\nin connection with the use of Service, the cars displayed on the Site may not\nbe available for you in your particular locality. The cabs displayed in the\nSite is subject to availability.<\/li><li>Vendor \/ Partner will be solely responsible for compliance with any\napplicable statutory or department of motor vehicles requirements and for all\nnecessary contacts with your insurance provider. Other than any personal\ncriminal liability attaching to the End Service Provider, the User will be\nsolely responsible for all consequences arising out of the use of the Service\nor the End Service Provider. In any event MAPCABSy shall have no responsibility\nor liability on this account whatsoever.<\/li><li>The User specifically authorize MAPCABS to collect, store or otherwise\nuse the User\u2019s \u2018Sensitive personal data or information\u2019 as defined in\nInformation Technology (Reasonable security practices and procedures and\nsensitive personal data or information) Rules, 2011in order to provide the\nServices.<\/li><li>MAPCABS agrees to take all reasonable steps to prevent internet fraud\nand ensure any data collected from the User is stored as securely and safely as\npossible. However, MAPCABS shall not be held liable in the unlikely event of a\nbreach in MAPCABS secure computer servers or those of third parties.<\/li><\/ul>\n\n\n\n<p><strong>DISCLAIMER<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The information on the MAPCABS App and or other user interface is\nprovided on an \u201cas is\u201d basis and the User agrees and accepts that the use of\nthe Services provided by MAPCABS is at the sole risk of the User, and further\nacknowledges that MAPCABS disclaims all representations and warranties of any\nkind, whether express or implied. Nothing herein shall to any extent substitute\nfor the independent investigations and the sound technical and business\njudgment of the Users.<\/li><li>In no event shall MAPCABS be liable for any direct, indirect,\nincidental, punitive, or consequential damages of any kind whatsoever with\nrespect to the Service.<\/li><li>Without prejudice to the above, MAPCABS makes no representation or\nwarranty that the&nbsp;Services will meet the User\u2019s requirements and\/or\nthe&nbsp;Services will be uninterrupted, timely, secure, or error-free.<\/li><li>MAPCABS disclaims all responsibility for any delays that cause the User\nto miss any engagements including without limitation, meetings, engagements,\ntrains, flights or buses. MAPCABS will not be liable to pay for any loss,\ndamages or compensation caused by such delays.<\/li><li>MAPCABS only acts as intermediary between the End Service Provider and\nthe User. MAPCABS disclaims any and all liability in respect of the End Service\nProvider including any claims of employment or any vicarious liability arising\nout of the Service or otherwise.<\/li><li>MAPCABS takes reasonable steps to keep the MAPCABS App and other user\ninterface and its contents correct and up to date, however, MAPCABS disclaims\nany guarantee that the contents are free of errors, defects, malware and\nviruses or that the information on the MAPCABS App and other user interface\nchannels are correct, up to date and or accurate.<\/li><li>MAPCABS shall not be liable for any damages resulting from the use of,\nor inability to use, the MAPCABS App, including without limitation damages\nresulting from failure or delay in delivery of electronic communications,\ninterception or manipulation of electronic communications by third parties or\nby computer programs used for electronic communications, damages caused by\nmalware, viruses or any incorrectness or incompleteness of the information on\nthe MAPCABS App or other user interface.<\/li><li>Although MAPCABS may include links or access to external links and web\npages, MAPCABS is not responsible for the accuracy or the content of the information\nthat is contained in the sites\/apps. Links from MAPCABS to third party\nsites\/apps do not constitute an endorsement by MAPCABS of the parties or their\nproducts and services. The appearance of the information of these third parties\ndoes not constitute an endorsement by MAPCABS.<\/li><li>MAPCABS is responsible only for linking of the User and the End Service\nProvider that are done through the use of its MAPCABS App or other user\ninterface, by the User. MAPCABS will not be responsible for the quality of\nservice provided by the End Service Provider, his acts, actions, behaviour,\nconduct, and\/or negligence, screening, safety or otherwise controlling\ntransactions, including whether the transaction between the User and the End\nService Provider is legal and valid as per the laws of the land of the User.<\/li><li>MAPCABS is not responsible for any errors, omissions or representations\non any of its pages or on any links or on any of the linked app or website\npages. MAPCABS does not endorse any advertiser on its web pages in any manner.\nThe Users are requested to verify the accuracy of all information on their own\nbefore undertaking any reliance on such information.<\/li><li>MAPCABS reserves the right, in its sole discretion, to terminate the\naccess to any or all MAPCABS App, websites or its other sales channels and the\nrelated Services or any portion thereof at any time, without notice, for\ngeneral maintenance or any reason what so ever.<\/li><\/ul>\n\n\n\n<p><strong>ENTIRE\nAGREEMENT<\/strong><\/p>\n\n\n\n<p>This User Agreement and the Privacy\nPolicy constitutes the entire agreement between the User and MAPCABS, in\nrelation to the use of MAPCABS App and or other user interface and supersede\nall previous agreements in relation to the MAPCABS App and or other user\ninterface belonging to MAPCABS.<\/p>\n\n\n\n<p><strong>VARIATION<\/strong><\/p>\n\n\n\n<p>We reserve the right to revise the\nterms in this User Agreement from time-to-time. The revised terms will apply to\nthe use of MAPCABS App and other user interface from the date of the\npublication of the revised User Agreement on MAPCABS App or on its other user\ninterface. Please check this User Agreement regularly to ensure the User is\nfamiliar with the current version.<\/p>\n\n\n\n<p><strong>FORCE\nMAJEURE<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>MAPCABS shall not be liable for delays or inabilities in performance or\nnon-performance in whole or in part of its obligations due to any causes that\nare not due to its acts or omissions and are beyond its reasonable control,\nsuch as acts of God, fire, strikes, embargo, acts of government, acts of\nterrorism or other similar causes, problems at routes, roads, highways,\ntransporters end.<\/li><li>The User agrees that there can be exceptional circumstances where the\nEnd Service Providers may be unable to honour the confirmed bookings due to\nvarious reasons like climatic conditions, labour unrest, insolvency, business\nexigencies, government decisions, operational and technical issues, etc. If\nMAPCABS is informed in advance of such situations where dishonour of bookings\nmay happen, it will make its best efforts to provide similar alternative to its\nUsers. The User agrees that MAPCABS being facilitator of the booking services\nshall not be responsible for any such circumstances and the Users have to\ncontact the said End Service Provider directly for any further resolutions and\nrefunds<\/li><li>Without prejudice to the above, MAPCABS makes no representation or\nwarranty that the&nbsp;Services will meet the User\u2019s requirements and\/or\nthe&nbsp;Services will be uninterrupted, timely, secure, or error-free.<\/li><li>The User agrees that in situations due to any technical or other failure\nin MAPCABS, Services committed earlier may not be provided or may involve substantial\nmodification. In such cases, MAPCABS shall refund the entire amount received in\nadvance from the User for availing such Services minus the applicable\ncancellation, refund or other charges, which shall completely discharge any and\nall liabilities of MAPCABS against such non-provision of Services or\ndeficiencies. Additional liabilities, if any, shall be borne by the User.<\/li><\/ul>\n\n\n\n<p><strong>GOVERNING\nLAW<\/strong><\/p>\n\n\n\n<p>This User Agreement shall be governed\nby and construed in accordance with the laws of the Republic of India.<\/p>\n\n\n\n<p><strong>DISPUTE\nRESOLUTION<\/strong><\/p>\n\n\n\n<p>If any dispute, controversy or claim\namong the User and MAPCABS arises out of or in connection with this User\nAgreement, including the breach, termination or invalidity hereof (\u201cDispute\u201d),\nthe parties shall use all reasonable endeavours to negotiate with a view to\nresolving the Dispute amicably. If a party gives the other parties notice that\na Dispute has arisen (a \u201cDispute Notice\u201d) and the parties mutually agree that\nany dispute, controversy or claim arising out of or relating to this contract\nshall first be referred to mediation at the Centre for Advance Mediation\nPractice (CAMP- www.campmediation.in) under the CAMP Rules of Mediation, 2015\nas may be modified or revised from time to time. In the event the Parties are\nunable to resolve such dispute(s) within three (3) months of commencement of\nthe mediation, which time limit is extendable by mutual agreement, then the\nParties agree that the dispute(s) will be submitted for resolution to binding\narbitration in accordance with the rules of The Arbitration and Conciliation\nAct, 1996. The venue of the arbitration shall be Bengaluru. The language of the\narbitration shall be English. No party may commence any court proceedings or\narbitration in relation to any dispute arising out of this User Agreement until\nit has attempted to settle the dispute through mediation. The Parties shall\nbear their own legal and other costs and expenses necessary to the Dispute,\nwhich has been submitted to arbitration in accordance with this Clause, without\nprejudice to the arbitrator\u2019s right to award costs or require any party to the\narbitration to pay the costs and expenses of another party thereto.
